1. Introduction:

Real Barber s.r.o. processes your personal data in accordance with applicable legislation, in particular Regulation (EU) No. 2016/679 of the European Parliament and of the Council, commonly known as GDPR. This document explains the principles of personal data protection, including a description of the data collected, the purpose of their processing, the persons to whom this data may be provided, and the rights you have in connection with the protection of your personal data.

3. Categories of personal data:

We only collect and process personal data that you provide to us in connection with the use of our services, in the following categories:

3.1. Identification data:

Includes name, surname, title, birth number or date of birth, permanent address, type and number of identity document (ID card or passport), country, issuing authority and validity period of the document. In the case of natural persons, entrepreneurs, it also includes tax identification number (DIČ) and identification number (IČ).

3.2. Contact data:

This includes your contact information, such as email address, telephone number and contact address.

3.3. Data about goods and use of services:

This data includes information about the goods and services you have purchased from us or with whom you have dealt (including records of telephone calls or other communications). It may also include information about your visit to our website, such as your IP address, cookies and other online identifiers.

4. Legal basis for processing:

We process your personal data on the basis of the following legal grounds:

  • Consent: The consent you provide when filling out a form or other form of communication.
  • Performance of the contract: Processing of data necessary for the performance of contractual obligations arising from our agreements.
  • Legal obligations: Compliance with legal requirements, such as tax and accounting obligations.
  • Legitimate interests: Protection of our legitimate interests, such as protecting our rights or managing customer relations.

The main legal regulations include Act No. 89/2012 Coll., the Civil Code, the Accounting Act, the VAT Act, the Consumer Protection Act and others.

We process personal data manually and electronically using automated systems. We use technical, organizational and personnel measures for data protection, the effectiveness of which we regularly review.

6. Recipients and processors of personal data:

Your personal data may be provided to the following entities:

  • External collaborators and suppliers for the purpose of fulfilling the contract.
  • Technical and software service providers.
  • Marketing agencies and advertising providers for the purpose of processing marketing campaigns.
  • Payroll providers, security agencies and law firms if necessary.

7. Transfer of personal data to third countries:

Your personal data is not transferred outside the European Union.

8. Retention period of personal data:

We store your personal data for the period strictly necessary to fulfill legal obligations, contractual obligations or based on your consent. Personal data processed on the basis of consent is stored for the duration of the consent or until its withdrawal.

9. Your rights in connection with the protection of personal data:

You have the following rights regarding the processing of your personal data:

9.1. Right to access personal data:

You have the right to obtain confirmation as to whether we are processing your personal data and, if so, to access such data, including information on the purpose of the processing, the categories of data processed, the recipients and the retention period.

9.2. Right to rectification of personal data:

If you find that any of your personal data that we process is inaccurate or incomplete, you have the right to request that it be corrected or completed.

9.3. Right to erasure of personal data (“right to be forgotten”):

You have the right to request that we erase your personal data if:

  • the data are no longer necessary for the purpose for which they were collected;
  • you withdraw your consent and there is no other legal ground for the processing;
  • you object to the processing and there are no overriding legitimate grounds;
  • the personal data have been processed unlawfully;
  • the personal data must be erased for compliance with a legal obligation.

9.4. Right to restriction of processing:

You have the right to request that we restrict the processing of your personal data if:

  • you contest the accuracy of the data – the processing will be restricted until we verify the accuracy;
  • the data is processed unlawfully, but instead of erasure you only request its restriction;
  • you no longer need the data for the purposes of the processing, but you need it for the establishment, exercise or defence of legal claims;
  • you object to the processing based on legitimate interest – the restriction applies until we verify whether our legitimate reasons outweigh them.

9.5. Right to data portability:

If we process your personal data in an automated manner based on consent or a contract, you have the right to receive this data in a structured, commonly used and machine-readable format, so that you can transmit it to another controller. You also have the right to request that we transmit it directly to another controller, where technically feasible.

9.6. Right to object:

You have the right to object at any time to the processing of your personal data for legitimate interest reasons, including profiling. If your data is processed for direct marketing purposes, you have the right to object at any time and your data will no longer be processed for these purposes.

9.7. Right to withdraw consent:

If you have given us consent to the processing of your personal data, you have the right to withdraw this consent at any time. However, the withdrawal of consent does not affect the lawfulness of processing that was carried out on the basis of consent before its withdrawal.

9.8. Right to lodge a complaint with a supervisory authority:

You have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data is not in accordance with the legal regulations on the protection of personal data. In the Czech Republic, the supervisory authority is the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7, tel. +420 234 665 111.

9.9. Exercise of rights:

You can send all requests regarding your rights to our contacts listed above. We will respond to requests without undue delay, usually within 30 days. In the case of more complex requests, we reserve the right to extend this period by another two months, and we will inform you of this, including the reason for the extension.

10. Personal data of employees and job
applicants:

This section describes how we process the personal data of our employees and job applicants and includes the following categories of data:

  • Identification data: name, surname, date of birth, social security number.
  • Contact data: permanent address, telephone number, e-mail address.
  • Other personal data: information about education, marital status, health insurance data, photos, ID card number.

We process this data for the purposes of fulfilling employment contracts, legal obligations (tax, accounting) and legitimate interests (e.g. protection of property and health).
